Indigal's Terms and Conditions of Temporary Holiday Accommodation

Note: Variances may be agreed on but only by arrangement with the owner in writing.

1. Deposit of 50% is required to secure the booking. Payment of the rental deposit constitutes the clients acceptance of these Terms and Conditions.

2. Balance of the rental amount must be received in full 7 days prior to occupancy. If not, the owner has the right to cancel the booking and attempt to re-let it. If paying cash, the full amount outstanding must be paid on arrival; otherwise, the owners reserve the right to charge the full amount (without the cash discount) to the tenants/guest credit card.

3. Cancellation of booking if caused by the client: full money paid is refundable if cancellation occurs: outside 60 days of booking; between 60 and 30 days prior to booking: 50% of deposit is non-refundable; inside 30 days of booking: deposit is non-refundable unless the house is re-let for the entire period. If a refund is made, due to the property being re-let, then a $50 cancellation fee will apply.

4. The owners will make every effort to ensure the property is available as booked. However the owners reserve the right to make alterations to bookings due to unforeseen circumstances and a full refund of monies paid will apply.

5. To maintain a good standard for our tenants/guests, we require certain conditions to be complied with. We appreciate most tenants/guests will respect our property but the occasional abuse requires that we state the following conditions.

6. Number of Guests should not exceed the number stated on the Confirmation Notice or subsequently agreed in writing or email. Fees will apply for excess guests not agreed with the owners in advance.

7. No smoking inside the house or in the gypsy wagon.

8. Parties and Functions are strictly prohibited (unless prior arrangement is made in writing with owners – fees apply). The Holiday Rental price charged is for domestic use only and not commercial. Accordingly this rate does not allow for the extra wear associated with functions in terms of cleaning, wear and tear, repairs etc. Use contrary to this may result in loss of your bond and/or additional payments.

9. Damage, Breakages, Theft and Loss are the tenants /guests responsibility during their stay. All damages, breakages and losses are to be reported to the owners immediately.

10. No open flame candles are to be used inside the house, on verandahs or decks, in pergola, pool area or on furniture.

11. If using the outdoor open fireplace, please build the fire on the grate in the fireplace. This ensures a safe sized fire. Large fires in the fireplace are dangerous and prohibited.

12. If a baby is in your party, please ensure disposable nappies are placed in plastic bags before placing in the bin, and make sure these bins are emptied into the wheelie bins at the end of your stay.

13. The moving of furniture, such as lounges, indoor dining tables, plants, etc is not permitted.

14. All premises are fully equipped including linen (e.g. sheets, pillow cases, towels, bath mats, pool towels, tea towels, tablecloths etc). A small complimentary supply only of kitchen/ bathroom equipment (detergent/soap etc) is provided.

15. Premises are furnished to the individual property owner’s taste and style and they take no responsibility for any unmet expectations of tenants /guests, or any changes made by the owner to the décor, furnishings and equipment in the premises.

16. Any repairs, maintenance or service reported and requested by tenants /guests to be made to the premises or any equipment provided at the premises, and/or deemed necessary by the owners, will be effected as soon as practicable, however no recompense will be negotiated due to the failure of any services, equipment or other contents provided at the premises. Tenants /guests are required to allow repair and or service personnel to enter the premises during reasonable hours by arrangement (and at any time in an emergency) for the purpose of conducting any repairs, maintenance or service. Tenants /guests requesting a service call which is subsequently found not to be required will be charged the applicable service call-out fee.

17. If on arrival by a tenant /guest the premises are unclean, or it comes to the attention of the tenant/guest that the premises have been damaged, they must promptly notify the owners and allow contractors or employees access to the premises for the purposes of inspection and if necessary cleaning or repairing of damage.

18. The owner of the premises are not responsible for, and tenants /guests hereby release them from any liability in respect of, any injury, debt, damage, loss, cost, delay, expense or inconvenience caused directly or indirectly by events beyond the owner’s control.

19. No swimming, jumping or diving into any dams or ponds on the property.

20. Tenants /guests will be responsible for costs incurred for retuning TV/VCRs which have been detuned by tenants /guests or by the attachment of electronic devices, play stations etc. The cabling at the back of the Pioneer system in the main lounge room MUST NOT be touched or changed in any way or under any circumstances.

21. If you are using the gas heater in the main lounge room, please make sure nothing is placed on top or directly in front of it – including children.

22. Departure - the property should be left in a similar state to its condition on arrival. Tenants /guests are to ensure that dishes are washed, dried and put away, floors swept, BBQ cleaned and garbage placed in wheelie bins provided at the property’s front gate, etc. Indigal provides a 7 hour standard clean after you depart. Any cleaning required beyond this is charged to you at $45/hour and deducted from your bond.

23. Excess garbage, bottles and boxes will not be collected by Council and must be removed and disposed of by guests, or arrangements made with owners (fees from $30.00 apply). Do not use the wheelie bins at the back of the property without permission from owners. A minimum $30/bin will be charged for use (with our without permission) of these wheelie bins.

24. Disturbance to neighbours, including excessive noise and/or disturbances arising from guests pets (see below conditions on ‘Pets’), is prohibited and may result in termination of rental and/or loss of bond. Noise must be reduced to a minimum and outside speakers turned off at midnight on weekends (Friday and Saturday nights) and 10pm on week nights (Sunday to Thursday).

25. The second residence on the property is used by the owners or caretakers. Owners and caretakers will make every effort to ensure tenant/guest privacy.

26. Check-out time is 10am by the latest, to allow time to prepare property for next guests, unless prior written arrangements are made with owners. If tenants /guests fail to comply with agreed check-out time, a fee (of up to a day’s rent) will be charged.

27. Bond of $2000.00 is payable at the same time as the balance amount and is payable by direct deposit. The bond will be refunded within 14 days after check-out date in full subject to the above conditions being met. It is designed to cover any additional costs incurred including but not limited to, any breakage, damage or excess cleaning requirements (exceeding 7 hours), extra guests beyond those declared, damage to by guests, dogs, etc.

28. If a refund is required, monies will be paid by cheque or direct deposit.

29. Children: Due to the nature of this property, i.e. unfenced dams, ponds, extensive bushland, fenced swimming pool, etc, children are the full responsibility of the tenants /guests and release the owners of the property from any liability.

30. Swimming Pool: Pool gate must be kept closed at all times. No glass or dogs to be taken into pool enclosure. Tenants /guests are responsible for any injury or damage to persons or property arising from the use of this area. Children must be supervised at all times while in pool enclosure.

31. Pets:
a) Written permission is required for tenants /guests to bring pets of any kind.
b) A maximum of 2 dogs are allowed with prior arrangements in writing with the owner.
c) Dogs must be kept outside.
d) All dog waste must be placed in plastic bags and disposed of with the garbage.
e) Dogs must not be allowed to wander onto neighbouring properties nor disturb the neighbours with prolonged barking.
f) Dog are not to be washed in showers or baths inside the house.
g) Tenants /guests are responsible for any damage incurred by the dogs including damage to furniture, gardens, lawns etc.
h) The property owners reserve the right to have dogs (pets) removed if the above conditions are not adhered to. Automatic loss of bond will apply.

Variations to these conditions may only be made by prior arrangements with the owner in writing.
